Connecticut: The General Assembly adjourned on June 7, 2023.
Louisiana: House Bill 179, which as amended, prohibits the sale of e-liquid of vapor products containing a characterizing flavor (exempts the flavor of tobacco), has failed after it did not receive a third and final reading on the Senate Floor prior to the Legislature adjourning on June 8, 2023. House Bill 635, which as amended, increases the tax on electronic cigarettes and vapor products from 5 cents per milliliter of consumable material to 15 cents per milliliter of consumable material, moved to the Governor on June 9, 2023.
Maine: LD1215 (SP496), which ends the sale of flavored tobacco products, has a divided report and has yet to be reported out of committee as of June 14, 2023. LD1558 (HB1003a), which prohibits the sale of tobacco products by pharmacies and retail establishments that contain pharmacies, was sent down by the House for concurrence on June 14, 2023. LD662 (HP431), which specifies that a municipality may not adopt or enforce an ordinance that prohibits a licensed tobacco retailer from selling flavored tobacco products, was sent down by the Senate for concurrence on June 14, 2023.
Nebraska: Legislative Bill 727, which as amended, imposes a tax on electronic nicotine delivery systems as the following rates: 1) The tax on an electronic nicotine delivery system containing three milliliters or less of consumable material shall be five cents per milliliter of consumable material. 2) The tax on an electronic nicotine delivery system containing more than three milliliters of consumable material shall be ten percent of the purchase price, was signed by the Governor on June 6, 2023. Effective January 1, 2024.
Nevada: Assembly Bill 232, which, for the period from July 1, 2023, through June 30, 2027, provides that the existing excise tax on premium cigars (30% of the wholesale price) will have a floor of not less than $0.30 and a cap of not more than $0.50 per cigar, was signed by the Governor on June 9, 2023.
New Jersey: Senate Bill 299 (menthol cigarette ban) and S2667 (menthol cigarette and flavored electronic smoking devices ban) were combined in the Senate Health, Human Services and Senior Citizens Committee on June 15, 2023. The Senate Committee Substitute for S2667 and S299 was approved and referred to the Senate Budget Committee.
New York: Assembly Bill 5994B (substituted for S536A), which provides for restrictions on certain advertisement and promotion of electronic cigarettes--addresses the suppression of information relating to the health consequences of electronic cigarettes, passed the Senate on June 8, 2023.
