State tobacco-related legislative bills that have been acted on by a state legislative committee or state legislature are listed below alphabetically by state:
Alaska: Senate Bill 89, which imposes a tax on electronic smoking products and vapor products at the rate of 25% of the sales price and caps the amount of nicotine in vapor products at 50 milligrams of nicotine per milliliter of vapor product, was not considered by the House prior to the legislature adjourning the 2023 session. It will be carried over to the 2024 session. The previous amended version of the bill would have capped these products at 60 milligram of nicotine per milliliter of vapor product.
California: Assembly Bill 935, which enforces the state flavor ban in the same manner as underage sales are enforced, passed the Assembly Appropriations Committee on May 18, 2023.
Colorado: House Bill 1290, which creates a ballot measure to be referred to voters in the next general election on November 7, 2023 that would determine whether the state is permitted to spend tobacco tax revenues that were received pursuant to the tax increase passed by voters in proposition EE that were in excess of the budget estimation in the analysis for the proposition, moved to the Governor on May 24, 2023. If voters were to reject the ballot measure the state would have to refund the $23.65 million of excess revenue to tobacco product distributors and wholesalers and reduce the cigarette and tobacco product tax rate by 11.53%.
Louisiana: House Bill 179, which prohibits the sale of e-liquid vapor products containing a characterizing flavor (exempts the flavors of tobacco, menthol, and mint), was referred to the Senate Health and Welfare Committee on May 22, 2023. House Bill 635, which as amended, increases the tax on electronic cigarettes and vapor products to 30 cents per milliliter of consumable material, was referred to the Senate Revenue and Fiscal Affairs Committee on May 24, 2023.
Maine: LD1215 (SP496), which ends the sale of flavored tobacco products, received a favorable majority vote on May 18, 2023. LD1174 (HP746), which ends the sale of flavored tobacco products, reported out “ought not to pass” in the Joint Committee on Health and Human Services on May 24, 2023. LD1558 (HB1003a), which prohibits the sale of tobacco products by pharmacies and retail establishments that contain pharmacies, received a favorable majority vote on May 18, 2023. LD662 (HP431), which specifies that a municipality may not adopt or enforce an ordinance that prohibits a licensed tobacco retailer from selling flavored tobacco products, was considered in work session by the Joint Committee on State and Local Government on May 25, 2023.
Nevada: Assembly Bill 53, which, as amended, increases penalties on retailers who sell to underage persons, passed the Senate Committee on Revenue and Economic Development on May 18, 2023, and passed the Senate on May 24, 2023; the bill is now ready for the Governor to consider.
