State tobacco-related legislative bills that have been acted on by a state legislative committee or state legislature are listed below alphabetically by state:

California: Assembly Bill 935, which enforces the state flavor ban in the same manner as underage sales are enforced, passed the Assembly on May 30, 2023.

Louisiana: House Bill 179, which as amended, prohibits the sale of e-liquid of vapor products containing a characterizing flavor (exempts the flavor of tobacco), was referred to the Senate Revenue and Fiscal Affairs Committee after a committee amendment was adopted on the Senate floor on June 1, 2023. The amendment that was adopted by the Senate removed exemptions for the flavors of menthol and mint. House Bill 635, which as amended, increases the tax on electronic cigarettes and vapor products to 50 cents per milliliter of consumable material, was placed on the calendar for a third and final reading on May 31, 2023.

Maine: LD1215 (SP496), which ends the sale of flavored tobacco products, has a divided report and has yet to be reported out of committee as of May 31, 2023. LD1558 (HB1003a), which prohibits the sale of tobacco products by pharmacies and retail establishments that contain pharmacies, has a divided report and has yet to be reported out of committee as of May 31, 2023. LD1174 (HP746), which ends the sale of flavored tobacco products, was placed in the Legislative File (DEAD) on May 30, 2023. LD662 (HP431), which specifies that a municipality may not adopt or enforce an ordinance that prohibits a licensed tobacco retailer from selling flavored tobacco products, was voted on, resulting in a divided report in the Joint Committee on State and Local Government on May 25, 2023.

Nebraska: Legislative Bill 727, which as amended, imposes a tax on electronic nicotine delivery systems as the following rates: 1) The tax on an electronic nicotine delivery system containing three milliliters or less of consumable material shall be five cents per milliliter of consumable material; and 2) The tax on an electronic nicotine delivery system containing more than three milliliters of consumable material shall be ten percent of the purchase price, passed the Legislature on June 1, 2023.

Nevada: Assembly Bill 53, which, effective January 1, 2024, increases penalties on retailers who sell to underage persons, was signed by the Governor on May 30, 2023. Assembly Bill 232, which, for the period from July 1, 2023, through June 30, 2027, sets the excise tax on each premium cigar as not less than $0.30 and not more than $0.50, passed the Assembly on May 31, 2023.
