On May 17, 2023, the U.S. House of Representatives Committee on Appropriations issued a draft of the Fiscal Year 2024 Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Bill which includes provisions that would prevent the FDA from banning the use of menthol in cigarettes, prohibiting characterizing flavors in all cigars, or setting a maximum nicotine level in cigarettes. The House Committee on Appropriations planned to mark up the draft legislation this week and then the bill needs to proceed through the full legislative process.
