Maine: LD1215 (SP496), which ends the sale of flavored tobacco products, was amended with an effective date of 1/1/25, is listed as “unfinished business” in the House on June 27, 2023. LD1808 defines a remote retail seller and requires a remote retail seller to obtain a license; it defines “cost price” and uses it to calculate the 43% tax rate on other tobacco products; placed on the Senate Special Appropriations Table on June 22, 2023.
Massachusetts: The following bills will be heard in the Joint Committee on Public Health on July 6, 2023: House Bill 2141 and Senate Bill 1345 exempt from the existing statewide flavored tobacco product ban any tobacco product that receives a Marketing Granted Order from the U.S. Food and Drug Administration. Senate Bill 1341 requires retailers that sell tobacco products to offer for sale at least one nicotine replacement therapy, drug, device, or combination product that has been approved by the FDA for tobacco cessation use. Senate Bill 1397 provides that no manufacturer or retailer shall sell, distribute, or cause to be distributed a tobacco product to a consumer, except in an adult-only retail tobacco store or in a smoking bar.
New Jersey: Senate Bill 2667, which prohibits the sale of all flavored cigarettes, including menthol, received a favorable vote from the Senate Budget and Appropriations Committee on June 27, 2023.
Ohio: House Bill 33 (budget bill), which includes language to establish state preemption and prohibit the sale of any flavored electronic liquid (excludes menthol and tobacco flavors) other than an electronic smoking device or electronic liquid for which a marketing order has been issued by the FDA, was referred to a conference committee on June 21, 2023.
Oregon: House Bill 3090, which would have prohibited the sale of flavored tobacco and vapor products except in hookah lounges and allowed for more restrictive local ordinances, died on adjournment on June 25, 2023.
