State tobacco-related legislative bills that have been acted on by a state legislative committee or state legislature are listed below alphabetically by state:
Colorado: House Bill 1290, which creates a ballot measure to be referred to voters in the next general election on November 7, 2023 that would determine whether the state is permitted to spend tobacco tax revenues that were received pursuant to the tax increase passed by voters in proposition EE that were in excess of the budget estimation in the analysis for the proposition, was signed by the Governor on June 2, 2023. If voters were to reject the ballot measure the state would have to refund the $23.65 million of excess revenue to tobacco product distributors and wholesalers and reduce the cigarette and tobacco product tax rate by 11.53%.
Hawaii: Senate Bill 975, which, effective January 1, 2024, establishes a tax on vapor products of 70% of the wholesale price, was signed by the Governor on June 6, 2023.
Louisiana: House Bill 179, which as amended, prohibits the sale of e-liquid of vapor products containing a characterizing flavor (exempts the flavor of tobacco), passed the Senate Revenue and Fiscal Affairs Committee on June 6, 2023 and is awaiting a third and final reading on the Senate Floor. The current version does not contain an exemption for menthol and mint flavored vapor products. House Bill 635, which as amended, increases the tax on electronic cigarettes and vapor products from 5 cents per milliliter of consumable material to 15 cents per milliliter of consumable material, has passed both chambers after the House concurred with Senate amendments on June 6, 2023.
Nebraska: Legislative Bill 727, which as amended, imposes a tax on electronic nicotine delivery systems as the following rates: (1) The tax on an electronic nicotine delivery system containing three milliliters or less of consumable material shall be five cents per milliliter of consumable material; and (2) the tax on an electronic nicotine delivery system containing more than three milliliters of consumable material shall be ten percent of the purchase price, was signed by the Governor on June 6, 2023. Effective January 1, 2024.
Nevada: Assembly Bill 232, which, for the period from July 1, 2023, through June 30, 2027, limits the 30% excise tax on each premium cigar as not less than $0.30 and not more than $0.50 per cigar, passed the Senate on June 5, 2023.
New York: Senate Bill 536, which provides for restrictions on certain advertisement and promotion of electronic cigarettes--addresses the suppression of information relating to the health consequences of electronic cigarettes, was recalled from the Assembly Committee and returned to “third reading” status in the Senate on June 5, 2023.
