State tobacco-related legislative bills that have been acted on by a state legislative committee or state legislature are listed below alphabetically by state:
Alaska: Senate Bill 89, which imposes a tax on electronic smoking products and vapor products at the rate of 25% of the sales price and caps the amount of nicotine in vapor products at 20 milligrams of nicotine for milliliter of vapor product, was considered in the Senate Labor and Commerce Committee on March 31, 2023.
Arkansas: House Bill 1725 requires the Director of Arkansas Tobacco Control to develop and maintain a directory listing of all vapor product manufacturers that have applied for a marketing order under federal law or has submitted a Pre-Market Tobacco Application (PMTA) with the FDA. HB1725 also prohibits the sale of any vapor product or e-liquid product that is not listed in the directory beginning July 1, 2024 and bans the advertising or marketing of tobacco products or vapor products with any marketing material that imitates or replicates food brands, products, characters, or symbols that are commonly marketed to children or minors. HB1725 was considered in the Senate City, County, and Local Affairs Committee on April 6, 2023.
Connecticut: The following bills failed the Joint Favorable deadline on March 29, 2023: House Bill 5381, which prohibits the sale of electronic nicotine delivery systems and vapor products that are flavored or have a nicotine content greater than 35 milligrams per milliliter. House Bill 6531, which prohibits the sale of flavored tobacco products, electronic nicotine delivery systems and vapor products. Senate Bill 532, which eliminates the requirement that sellers require identification from each person who purchase cigarettes or tobacco products.
Hawaii: Senate Bill 975, which establishes a tax on vapor products of an unspecified percentage of the wholesale price, passed the House Finance Committee with an amendment on April 4, 2023.
Idaho: House Bill 330, which implements a cigar tax cap of fifty cents per cigar, was signed by the Governor on April 4, 2023 and goes into effect on July 1, 2023.
Maine: The first regular session of the Legislature adjourned sine die on March 30, 2023. The first special session convened on April 5, 2023.
Oregon: House Bill 3090, which, effective July 1, 2024, prohibits the sale of flavored tobacco and vapor products except in hookah lounges, passed House Behavioral Health and Health Care Committee on April 3, 2023.
South Carolina: House Bill 3681, which prohibits political subdivisions from enacting any laws, ordinances, or rules pertaining to ingredients, flavors, or licensing of cigarettes, electronic smoking devices, e-liquid, vapor products, tobacco products, or alternative nicotine products; and provides that such laws, ordinances, and rules enacted by a political subdivision prior to December 31, 2020 are not subject to the preemption imposed by this act, reported favorably from the House Committee on Medical, Military, Public and Municipal Affairs on March 30, 2023.
Vermont: Senate Bill 18, which bans the retail sale of flavored cigarettes, flavored OTP, e-cigarettes and e-liquids (flavored includes menthol), was referred to the House Committee on Human Services on April 4, 2023.
