State tobacco-related legislative bills that have been acted on by a state legislative committee or state legislature are listed below alphabetically by state:
Alaska: Senate Bill 89, which imposes a tax on electronic smoking products and vapor products at the rate of 25% of the sales price and caps the amount of nicotine in vapor products at 20 milligrams of nicotine for milliliter of vapor product, will be considered in the Senate Labor and Commerce Committee on April 21, 2023.
California: Assembly Bill 935 was amended April 11, 2023, to provide that the state flavor ban will be enforced in the same manner as underage sales; before the amendment, the bill would have prevented sales of tobacco products to persons born after 2006.
Indiana: House Bill 1454, which contains language to cap the cigar tax at $.72 per cigar for cigars with a wholesale price exceeding $3.00 per cigar, passed the Senate as amended and was returned to the House on April 18th. A conference committee was appointed on April 19, 2023.
Maine: LD1174 and LD1215, both of which prohibit the sale of flavored tobacco products (including menthol), will be heard in the Joint Committee on Health and Human Services on April 25, 2023.
Nevada: Assembly Bill 232, which caps the excise tax on premium cigars at $0.50, passed Assembly Revenue Committee with an amendment on April 13, 2023. Assembly Bill 294 died on April 14, 2023, by missing a procedural deadline; it would have banned the sale of flavored cigarettes or vapor products, prohibited the sale of cigarettes to persons born after 2002, banned cigarette vending machines and, beginning January 1, 2030, banned the sale of all cigarettes.
Washington: Senate Bill 5365, which increases penalties for sales of tobacco and vapor products to underage persons, passed Senate on April 17, 2023; ready for Governor.
