State tobacco-related legislative bills that have been acted on by a state legislative committee or state legislature are listed below alphabetically by state:
Hawaii: Senate Bill 975, which establishes a tax on vapor products effective December 31, 2050, passed House Health Committee with an amendment on March 15, 2023. Senate Bill 1447, which, effective July 1, 2050, permits counties to regulate tobacco products consistent with but more stringently than state law, passed House Judiciary and Hawaiian Affairs Committee on March 15, 2023.
Maine: LD662 (HP431), which specifies that a municipality may not adopt or enforce an ordinance that prohibits a licensed tobacco retailer from selling flavored tobacco products, was heard in the Joint Committee on State and Local Government on March 16, 2023.
Mississippi: The following bills have died in committee: Senate Bill 2015, which would have imposed the current OTP excise tax of 15% of the manufacturer’s list price on vapor products. House Bill 746, which would have increased the tax on cigarettes by 50 cents per pack, and House Bill 755, which would have increased the OTP tax by 7.5% of the manufacturer’s list price.
Nebraska: Legislative Bill 745, which increases the tax on cigarettes by $1.50 per pack, will be considered in the Revenue Committee on March 23, 2023.
New Mexico: House Bill 547, which removes the cigar tax cap of 50 cents per cigar, was amended prior to passing the Senate on March 16, 2023. The current version now includes provisions that would increase the tax on electronic cigarettes and e-liquid to 31% of the wholesale price. The House refused to concur with the amended version of the bill on March 16, 2023, and it now moves to conference committee.
New Hampshire: House Bill 510, which removes the exemption for premium cigars from the tobacco tax, reported from the House Committee on Ways and Means majority as “ought not to pass” and reported from the minority as “ought to pass” on March 13, 2023.
North Dakota: House Bill 1412, which requires a license to sell electronic smoking devices, passed from the Senate Committee on Industry and Business on March 13, 2023.
Tennessee: Senate Bill 1522, which increases the cigarette tax from 3.0 cents to 8.35 cents per cigarette and increase the OTP tax from 6.6% to 17% of wholesale, was heard in the General Subcommittee of the Senate Finance, Ways and Means Committee on March 14, 2023; deferred until the first calendar of 2024.
Vermont: Senate Bill 18, which bans the retail sale of flavored cigarettes, flavored OTP, e-cigarettes and e-liquids (flavored includes menthol), was referred to the Senate Committee on Finance on March 14, 2023.
