Alaska: Senate Bill 89, which imposes a tax on electronic smoking products and vapor products at the rate of 25% of the sales price and caps the amount of nicotine in vapor products at 20 milligrams of nicotine for milliliter of vapor product, will be considered in the Senate Labor and Commerce Committee on March 31, 2023.
Connecticut: House Bill 6488, which prohibits the sale of flavored products (except menthol and tobacco), was substituted without the flavored tobacco ban language from the Joint Committee on Public Health on March 20th and reported out on March 29, 2023.
Idaho: House Bill 330, which implements a cigar tax cap of fifty cents per cigar, is eligible for the Governor to consider signing after passing the Senate on March 28, 2023.
Missouri: House Bill 124, which requires a new license from the ATC with annual fee per location; increases penalties for sales violations, was heard in the House Committee on Government Efficiency and Downsizing on March 29, 2023. House Bill 1039, which establishes that the state preempts the field of regulating the sale of tobacco products, alternative nicotine products and vapor products; supersedes local laws, ordinances, rules and regulations, will be heard in the House Committee on General Laws on April 3, 2023.
Nebraska: Legislative Bill 584, which imposes an excise tax on vapor products at a rate of 5 cents per milliliter of consumable material, passed the Revenue Committee on March 28, 2023. "Consumable material" is defined as any liquid solution or other material that is depleted as an electronic nicotine delivery system is used.
New Hampshire: House Bill 510, which removes the exemption for premium cigars from the tobacco tax, failed to pass the House on March 23, 2023.
New York: Senate Bill 536, which provides for restrictions on advertisement and promotion of electronic cigarettes--addresses research and misrepresentation of electronic cigarettes passed the Senate and was referred to the Assembly Committee on Consumer Affairs and Protection on March 27, 2023.
North Dakota: House Bill 1412, which requires a license to sell electronic smoking devices, was signed by the Governor on March 23, 2023.
Rhode Island: House Bill 6091 (companion to SB349), which allows cities and towns to create ordinances to regulate the use and sales of cigarettes, other tobacco products and electronic nicotine delivery systems, was heard in the House Municipal Government and Housing Committee on March 28, 2023. The committee recommended the measure be held for further study.
Vermont: Senate Bill 18, which bans the retail sale of flavored cigarettes, flavored OTP, e-cigarettes and e-liquids (flavored includes menthol), passed the Senate on March 30, 2023.
Washington: Senate Bill 5365, which increases penalties for sales of tobacco and vapor products to underage persons, passed House Regulated Substances & Gaming Committee on March 23, 2023.
