Alaska: Senate Bill 89, which imposes a tax on electronic smoking products and vapor products at the rate of 25% of the sales price and caps the amount of nicotine in vapor products at 20 milligrams of nicotine for milliliter of vapor product, will be considered in the Senate Labor and Commerce Committee on March 24, 2023.
Connecticut: House Bill 6488, which prohibits the sale of flavored cigarettes, tobacco products, electronic nicotine delivery systems and vapor products (excludes the flavors of menthol and tobacco), reported favorably from the Joint Committee on Public Health on March 20, 2023.
Hawaii: Senate Bill 975 establishes a tax on vapor products of an unspecified percentage of the wholesale price, passed House Judiciary and Hawaiian Affairs Committee with an amendment on March 22, 2023. Senate Bill 1447 permits counties to regulate tobacco products consistent with, but more stringently than, state law, passed the House Consumer Protection and Commerce Committee with an amendment on March 22, 2023.
Idaho: House Bill 330, which implements a cigar tax cap of fifty cents per cigar, passed the Senate State Affairs Committee on March 22, 2023. House Bill 331 (same as House Bill 199), which imposes a tax on electronic smoking products and devices at the rate of 40% of the wholesale price, was held in the House Revenue and Taxation Committee on March 17, 2023.
Maine: LD662 (HP431), which specifies that a municipality may not adopt or enforce an ordinance that prohibits a licensed tobacco retailer from selling flavored tobacco products, was tabled (pending resolution of flavor ban bills LD1174 and LD1215) at the work session of the Joint Committee on State and Local Government on March 23, 2023.
Nebraska: Legislative Bill 745, which increases the tax on cigarettes by $1.50 per pack, was considered in the Revenue Committee on March 23, 2023. LB745 remains in committee.
New Mexico: House Bill 547, which removes the cigar tax cap of 50 cents per cigar and applies the OTP tax of 25% of the product value to any product, other than cigarettes, e-liquid, and closed system cartridges, made from or containing nicotine (natural or synthetic), was adopted after conference committee on March 18, 2023, and is now eligible for the Governor. It is important to note that provisions that would have increased the tax on electronic cigarettes and e-liquid to 31% of the wholesale price were removed from the final version of the bill.
North Dakota: House Bill 1412, which requires a license to sell electronic smoking devices, was sent to the Governor on March 21, 2023.
Vermont: Senate Bill 18, which bans the retail sale of flavored cigarettes, flavored OTP, e-cigarettes and e-liquids, including menthol flavor, was heard in and reported favorably from the Senate Committee on Finance on March 23, 2023.
