State tobacco-related legislative bills that have been acted on by a state legislative committee or state legislature are listed below alphabetically by state:

Massachusetts: The following were among the bills heard in the Joint Committee on Public Health on November 3, 2021:

  • HB2237/SB2483: Exempt from the state flavor ban those products determined by the FDA to be either “appropriate for the protection of the public health” under 21 U.S.C. Sec. 387j or a modified risk tobacco product that is “to reduce harm or the risk of tobacco-related disease associated with commercially marketed tobacco products” under 21 U.S.C. Sec. 387(k).
  • HB2406/SB1433: Repeal the state flavor ban on tobacco products.
  • HB2310/SB1459: Restrict tobacco product sales to adult-only retail tobacco stores.

Michigan: House Bill 4485, which repeals the provision that is scheduled to remove the 50 cents per cigar excise tax cap on October 31, 2021, was signed by the Governor on November 4, 2021. Per the bill language, HB4485 takes effect immediately.
