New Jersey: AB 1989, which prohibits the sale of menthol cigarettes and, as amended, prohibits the sale flavored non-premium cigars and oral nicotine pouches, passed the Assembly Health Committee and was referred to the Assembly Appropriations Committee on November 20, 2023. The Legislature is scheduled to adjourn on 12/31/23.
Wisconsin: SB 268 creates requirements relating to retail licenses to sell cigarettes and tobacco products, including state uniformity on licensing and a requirement that a person who sells electronic vaping devices must obtain a cigarette and tobacco products retailer license. The bill was requires effective 7/1/25, that manufacturers of electronic vaping devices must certify that the manufacturer has received marketing authorization from the FDA, or the electronic vaping device was marketed in the U.S. as of 8/8/16 and the manufacturer submitted a PMTA by 9/9/20. The bill was sent to the Governor for final review on November 30, 2023, and has six days to act on the legislation.
