New York: Assembly Bill 5994B (substituted for S536A), which provides for restrictions on certain advertisement and promotion of electronic cigarettes--addresses the suppression of information relating to the health consequences of electronic cigarettes, was signed by the Governor on October 25, 2023. The effective date is January 1, 2024.

Pennsylvania: House Bill 1161, which prohibits the sale of flavored tobacco products (except flavored shisha tobacco products sold by a hookah tobacco retailer, loose leaf tobacco and premium cigars), was not taken up by the House Judiciary Committee on October 18, 2023. The committee will meet with stakeholders at a later date. House Bill 1657, which repeals exemptions from the 2008 Clean Indoor Air Act and removes state preemption pertaining to smoking in a public place, will be heard in the House Health Committee on November 15, 2023.
