Wisconsin: SB 268 creates requirements relating to retail licenses to sell cigarettes and tobacco products, including state uniformity on licensing and a requirement that a person who sells electronic vaping devices must obtain a cigarette and tobacco products retailer license. The bill requires, as of 7/1/25, that manufacturers of electronic vaping devices must certify that the manufacturer has received marketing authorization from the FDA, or the electronic vaping device was marketed in the U.S. as of 8/8/16 and the manufacturer submitted a PMTA by 9/9/20. The bill was approved by the Governor on December 6, 2023.
