Connecticut: House Bill 6488, which prohibits the sale of flavored cigarettes, tobacco products, electronic nicotine delivery systems and vapor products, was heard in the Joint Committee on Public Health on February 1, 2023.
Indiana: Senate Bill 264, which changes the cigarette tax stamp discount to $.05 (currently $.013), passed from the Senate Public Policy Committee and referred to the Senate Appropriations Committee on February 2, 2023. House Bill 1214, which amends the definition of tobacco product to include a product containing nicotine; requires a distributor to purchase and distribute e-liquid from an Indiana e-liquid manufacturer or Indiana e-liquid distributor, passed the House on January 30, 2023.
Maryland: Senate Bill 259, which prohibits the sale of flavored tobacco products and electronic smoking devices (including menthol, mint, and wintergreen), will be heard in the Senate Finance Committee on February 16, 2023.
New Mexico: House Bill 94, which prohibits the sale of flavored tobacco products, passed the House Health and Human Services Committee on January 30, 2023. HB94 will be considered in the House Commerce and Economic Development Committee on February 6, 2023.
House Bill 123, which increases the tax on cigarettes by $2.00 per pack (from $2.00 to $4.00 per pack) and increases the tax on tobacco products by 46% of the wholesale price (from 25% to 71% of the wholesale price), passed the House Health and Human Services Committee on January 30, 2023. HB123 will be considered in the House Taxation and Revenue Committee on February 6, 2023.
House Bill 124, which increases the excise tax on tobacco products to 31% of the wholesale price, amends existing law to repeal the separate taxes imposed on vapor products and e-liquid for the purpose of imposing the proposed 31% of the wholesale price OTP rate on vapor products, and repeals the excise tax cap for cigars of 50 cents per cigar, passed the House Health and Human Services Committee on January 30, 2023.
Senate Bill 179, which permits localities and counties to enact ordinances and regulations related to tobacco products, will be considered in the Senate Health and Public Affairs Committee on February 6, 2023.
North Dakota: House Bill 1412, which requires a license to sell electronic smoking devices, reported as “do pass” from the House Committee on Industry, Business and Labor on February 1, 2023.
Virginia: House Bill 2296 (same as SB1350), which was substituted to direct the Secretary of Finance to assess a licensing scheme for liquid nicotine, reported from the House Finance Committee on February 1, 2023. Senate Bill 1350, which was substituted to direct the Secretary of Finance to assess a licensing scheme for liquid nicotine, passed the Senate on February 2, 2023.
