Connecticut: The 2021 regular legislative session adjourned June 9, 2021.
Iowa: The 2021 legislative session adjourned May 19, 2021.
Louisiana: House Bill 473, which raises the minimum age for the prohibition of the distribution or sale of tobacco, alternative nicotine products, or vapor products from persons under the age of 18 to those under the age of 21, passed the Senate as amended on June 7 and the House concurred with the amendments on June 8, 2021. The bill is now eligible for the Governor’s signature.
Maine: LD1693 / H.P.1258, which bans the sale of all flavored tobacco products (e. g. cigarettes, cigars, snuff, chew, END), increases the cigarette tax to $4.00 per pack and eliminates the cigarette stamping discount to distributors, was designated for carryover on June 3, 2021. LD221 / H.P. 156 (Governor’s budget bill changes), which includes a ban on the sale of all flavored tobacco products, was the subject of a work session in the Joint Committee on Appropriations and Financial Affairs on June 9, 2021.
Maryland: House Bill 1324 and cross-filed Senate Bill 883, both which require a person located outside the state to have a remote tobacco seller license to sell premium cigars or pipe tobacco to consumers in the state; both of which provide for the adjustment of the price base for the excise tax on premium cigars and pipe tobacco sold by out-of-state sellers and both of which specify a tax rate of 12% on tobacco pipes (as defined) and provide for refund of taxes paid on tobacco pipes after 3/14/21 to bill enactment, became law without the Governor’s signature on May 30, 2021. Both bills were effective upon enactment.
Michigan: House Bill 4878, which prohibits the sale of synthetic or tobacco free nicotine to an individual under 21 and requires the product packaging to include a disclosure that the product is not regulated by the FDA was referred to the Senate Committee on Regulatory Reform on June 8, 2021. House Bill 4251, which prohibits the sale of vapor products or alternative nicotine products that contain Vitamin E Acetate, was referred to the Senate Committee on Regulatory Reform on June 8, 2021.
Missouri: The 2021 Legislative Session adjourned May 30, 2021.
North Carolina: House Bill 334 (as substituted in the Senate), which contains language to modify the excise tax on cigars to tax online sales the same as in-person sales (12.8% of the cost price with a cap of $.30 per cigar), passed the Senate on June 10, 2021.
Oregon: House Bill 2261, which prohibits remote sales of vapor products, was signed by the Governor on June 8, 2021. (Effective date TBD-approximately mid-September 2021.) Senate Bill 64, which allows for covert underage buyer checks on tobacco retailers, was signed by the Governor on June 8, 2021. (Effective date TBD-approximately mid-September 2021.)
Tennessee: Senate Bill 1047 (same as House Bill 705), which adds vapor products to the TN code pertaining to the Non-Smoker Protection Act—amends Tennessee code to preempt local governments concerning the regulation of tobacco products and vapor products (except for public use in certain locations), was signed by the governor on May 26, published on June 2 with an effective date of July 1, 2021.
Vermont: The 2021 regular session of the General Assembly adjourned sine die on May 21, 2021.
