State tobacco-related legislative bills that have been acted on by a state legislative committee or state legislature are listed below alphabetically by state:
Alaska: House Bill 110, which imposes a tax on electronic smoking products (including e-liquid) at the rate of 75% of the wholesale price and increases the legal age to purchase and possess tobacco and vapor products to 21 years of age, will be considered in the House Finance Committee on May 14, 2021.
Arizona: House Bill 2682, which raises the minimum legal sales, purchase, use and possession age to 21, requires tobacco product retailers to obtain a license from the Department of Liquor Licenses and Control, preempts most local regulation of sales and marketing of tobacco products, and provides for penalties for sales to underage persons, passed Senate on May 6, 2021.
Connecticut: House Bill 6110, which limits the sales and shipment of ENDS to consumers in the state to two vapor products and 30 cartridges in one month, passed the House on May 12, 2021.
Florida: Senate Bill 1080, which increases the legal age to purchase and possess tobacco products and vapor products to 21 years of age and requires nicotine product retailers to be licensed and provides that the establishment of the minimum age for purchasing or possessing tobacco product or nicotine products and the regulation of the marketing, sale, or delivery of tobacco products or nicotine products is preempted to the state, was signed by the Governor on May 7, 2021.
Illinois: An amended version of Senate Bill 512, which sets packaging, ingredient, and marketing requirements for e-cigarettes.; prohibits a manufacturer, distributor, or retailer from advertising, marketing, or promoting an electronic cigarette in a manner that: (1) encourages persons under 21 years of age to use an electronic cigarette; or (2) is attractive to persons under 21 years of age, including, but not limited to, inclusion of the following: (A) cartoons; (B) an image, character, or phrase that is similar to one popularly used to advertise to children; or (C) a video game, movie, video, or animated television show known to appeal primarily to persons under 21 years of age; and prohibits the honoring or acceptance of any discount, coupon, or other benefit or reduction in price that is inconsistent with 21 CFR 1140, subsequent United States Food and Drug Administration industry guidance, or any rules adopted under 21 CFR 1140, was placed on the calendar for second reading in the House on May 12, 2021. The amended version of the bill removed a provision that would have made it unlawful to sell in any one transaction more than 2 electronic cigarettes, 4 prepackaged cartridges of electronic cigarette solution, or 100 milliliters of electronic cigarette solution to a consumer.
Louisiana: House Bill 525, which amends the definition of smokeless tobacco to exclude any product which includes nicotine if the product does not contain any other substance considered to be smokeless tobacco. The measure excludes these types of products from the 20% tax imposed on smokeless tobacco, passed the House on May 11, 2021 and has been referred to the Senate Revenue and Fiscal Affairs Committee. House Bill 473, which raises the minimum age for the prohibition of the distribution or sale of tobacco, alternative nicotine products, or vapor products from persons under the age of 18 to those under the age of 21, passed the House on May 10, 2021 and has been referred to the Senate Committee on Judiciary.
Maine: LD1423 / H.P. 1039, which increases the cigarette tax from $2.00 per pack to $4.00 per 20 pack and, by law, the bill increases the tax on other tobacco products by the same percentage change as the increase in the tax on cigarettes, was heard in the Joint Committee on Taxation on May 13, 2021. HP1155 / LD1550, which prohibits the sale and distribution of all flavored tobacco products and ENDS (includes menthol products), was voted on in a work session of the Joint Committee on Health and Human Services on May 12, 2021 and received a “ought to pass” designation.
Michigan: House Bill 4485, which repeals the provision that is scheduled to remove the 50 cents per cigar excise tax cap on October 31, 2021, received a second reading in the House on May 13, 2021 and has moved to third reading.
Montana: Senate Bill 398, which prohibits a local government from adopting or enforcing any local ordinance or resolution that prohibits the sale of alternative nicotine products or vapor products, was signed by the Governor on May 10, 2021.
Nevada: Assembly Bill 59, which increases the minimum legal sales age to 21, reduces penalties for retail clerks making illegal sales to underage persons and regulates remote sales of tobacco products, passed Senate Judiciary Committee on May 12, 2021.
Oregon: House Bill 2261, which prohibits remote sales of vapor products, passed Senate Health Care Committee on May 12, 2021.
Tennessee: The General Assembly adjourned sine die on May 5, 2021. All pending legislation will carry-over to the 2022 session.
Texas: House Bill 211, which has been reverted to its original form and taxes vapor products at 5 cents per milliliter, passed the House and moved to the Senate on May 7, 2021.
