Connecticut: Senate Bill 326, which prohibits the sale of flavored cigarettes, tobacco products, electronic nicotine delivery systems and vapor products, will be heard in the Joint Public Health Committee on February 8, 2021. (Previously scheduled hearing for February 1st was cancelled due to weather.) Senate Bill 115, which prohibits any health care facility or pharmacy from selling cigarettes, tobacco products, ENDS and vapor products, will be heard in the Joint Public Health Committee on February 8, 2021.
Indiana: House Bill 1434, which increases the cigarette tax by $1.00 per pack and imposes a tax on e-liquid containing nicotine at $0.08 per milliliter, passed from the House Public Health Committee on February 4, 2021. Senate Bill 142, which requires retailers to use scanning technology or an automated software system to verify age, passed from the Senate Public Policy Committee on February 3, 2021.
Kansas: House Bill 2061, which prohibits the sale of flavored vapor products (exempts the flavors of tobacco and menthol), increases the minimum age to purchase and possess tobacco products and vapor products from 18 to 21 years of age, prohibits cigarette vending machines, and increases the fee for a retail dealers license to $100 for each establishment, was scheduled to be considered in a hearing in the House Federal and State Affairs Committee on February 2, 2021, but the committee meeting was cancelled.
Maryland: House Bill 134 (cross-filed with Senate Bill 177), which prohibits the sale of flavored tobacco products and electronic smoking devices (includes menthol, mint and wintergreen), will be heard in the House Economic Matters Committee on February 10, 2021. Senate Bill 378, which authorizes Baltimore City to enact and enforce local laws to regulate the sale and distribution of cigarettes, other tobacco products and electronic smoking devices, will be heard in the Senate Finance Committee on February 11, 2021. Senate Bill 410, which authorizes a county or municipality to enact and enforce local laws to regulate the sale and distribution of cigarettes, other tobacco products and electronic smoking devices, will be heard in the Senate Finance Committee on February 11, 2021.
Montana: House Bill 137, which limits local governing units and the Department of Public Health and Human Services from establishing requirements on alternative nicotine products or vapor products and amends the Youth Access to Tobacco Products Act to clarify that alternative nicotine products or vapor products are separate and distinct from tobacco products, passed the House on February 1, 2021 and was referred to the Senate Business, Labor, and Economic Affairs Committee on February 2, 2021.
New Hampshire: Senate Bill 62, which prohibits the sale of flavored e-cigarettes and e-cigarette cartridges (exempts menthol), requires manufacturers to inform the Department of Environmental Services of toxic materials in such e-cigarettes and requires the DES to make rules for the disposal of such e-cigarettes, received a recommendation of “inexpedient to legislate” from the Senate Commerce Committee on February 1, 2021
New Mexico: House Bill 167, which increases the tax on cigarettes by $2.00 per pack, increases the OTP tax to 83% of the product value, increase the tax on e-liquid to 83% of the product value, and increases the tax on closed system cartridges to $3.32 per cartridge, will be considered in the House Health and Human Services Committee on February 8, 2021. Senate Bill 95, which grants counties and municipalities the authority to adopt ordinances and regulations pertaining to the sale of tobacco products that are stricter than state law, passed the Senate Health and Public Affairs Committee on January 29, 2021. SB95 is currently in the Senate Judiciary Committee. House Bill 97, which grants counties and municipalities the authority to adopt ordinances and regulations pertaining to the sale of tobacco products that are stricter than state law, passed the House Health and Human Services Committee on February 2, 2021. HB97 is currently in the House Local Government, Land Grants, and Cultural Affairs Committee.
Virginia: Senate Bill 1326, which would require counties to participate in a regional cigarette tax board in order to impose a county cigarette tax, reported from the Senate Finance and Appropriations Committee on February 3, 2021.
Washington: Senate Bill 5129, which, as amended, removes civil liability for minors who purchase, use, or possess tobacco products, passed the Senate Committee on Human Services, Reentry and Rehabilitation with an amendment on January 29, 2021.
