State tobacco-related legislative bills that have been acted on by a state legislative committee or state legislature are listed below alphabetically by state:
Arizona: House Bill 2118, which increases the minimum legal sales age to 21 and provides for civil penalties for enterprises selling to underage persons, passed the House Commerce Committee with an amendment on January 26, 2021.
Connecticut: Senate Bill 326, which prohibits the sale of flavored cigarettes, tobacco products, electronic nicotine delivery systems and vapor products, was introduced on January 25th and will be heard in the Joint Public Health Committee on February 1, 2021.
Kansas: House Bill 2061, which prohibits the sale of flavored vapor products (exempts the flavors of tobacco and menthol), increases the minimum age to purchase and possess tobacco products and vapor products from 18 to 21 years of age, prohibits cigarette vending machines, and increases the fee for a retail dealers license to $100 for each establishment, will be considered in a hearing in the House Federal and State Affairs Committee on February 2, 2021.
Maryland: Senate Bill 177, which prohibits the sale of flavored tobacco products and electronic smoking devices (includes menthol, mint and wintergreen), was heard in the Senate Finance Committee on January 28, 2021. Senate Bill 273, which concerns electronic smoking device regulation, was heard in the Senate Finance Committee on January 28, 2021. Senate Bill 378, which authorizes Baltimore City to enact and enforce local laws to regulate the sale and distribution of cigarettes, other tobacco products and electronic smoking devices, will be heard in the Senate Finance Committee on February 11, 2021. Senate Bill 410, which authorizes a county or municipality to enact and enforce local laws to regulate the sale and distribution of cigarettes, other tobacco products and electronic smoking devices, will be heard in the Senate Finance Committee on February 11, 2021.
Missouri: Senate Bill 124, which includes vape and e-cigarettes in the Clean Indoor Air Act and raises the age to purchase to 21 along with other modifications, was heard in the Committee on Seniors, Families, Veterans and Military Affairs on January 27th.
New Hampshire: Senate Bill 62, which prohibits the sale of flavored e-cigarettes and e-cigarette cartridges (exempts menthol), requires manufacturers to inform the Department of Environmental Services of toxic materials in such e-cigarettes and requires the DES to make rules for the disposal of such e-cigarettes, will be heard in the Senate Commerce Committee on February 1, 2021. Senate Bill 76, which reduces the state excise tax on modified risk tobacco products, reported as “ought not to pass” from the Senate Ways and Means Committee on January 27, 2021.
New Mexico: Senate Bill 95, which grants counties and municipalities the authority to adopt ordinances and regulations pertaining to the sale of tobacco products that are stricter than state law, is scheduled to be considered in the Senate Health and Public Affairs Committee on January 29, 2021.
North Dakota: Senate Bill 2190, which prohibits the shipping of tobacco products and vapor products to any consumer and require the sale of tobacco products and vapor products to be made by face-to-face over-the-counter retail sales transactions, failed in the Senate on January 26th.
Washington: Senate Bill 5266 (see description of House Bill 1345 above) was referred out of the Senate Labor, Commerce & Tribal Affairs Committee to the Senate Health and Long Term Care Committee without recommendation on January 25, 2021.
Wyoming: House Bill 55, which increases the excise tax on cigarettes by $.24 per pack (from $.60 per pack to $.84 per pack) and also increases the tax on moist snuff by $.12 (from $.60 to $.72) for any amount of moist snuff up to 1 ounce plus a proportionate rate at the like rate on any fractional parts of more than 1 ounce, was placed on General File for consideration by the House on January 27, 2021.
