Kentucky: On September 22, 2020, the Interim Joint Committee on Local Government received a presentation by The Foundation for a Healthy Kentucky regarding local control of tobacco sales and marketing. Tobacco control interests are expected to push legislation in the 2021 legislative session to grant local governments the authority to regulate the sale of tobacco products. The committee next meets on October 27th.
Michigan: The following bills were referred to the House Ways and Means Committee, as substituted, on September 22, 2020: Senate Bill 781, as amended, imposes a new tax on the consumable material used in vapor products at the rate of 18% of the wholesale price and also taxes alternative nicotine products at 50 cents per ounce of alternative nicotine product based on the net weight listed by the manufacturer; Senate Bill 782, which requires a license to sell tobacco products, alternative nicotine products, and vapor products; Senate Bill 783, which prohibits the advertising of vapor products in a manner that causes a minor to believe that health benefits may be derived from the use of vapor products. SB783 also allows the sale of flavored vapor products; Senate Bill 784, which increases the legal age to purchase tobacco products, alternative nicotine products, and vapor products from 18 to 21 years of age; Senate Bill 785, which modifies the age requirement provisions in the penal code relating to the sale or distribution of tobacco products by mail or vending machines; and House Bill 4039, which increases the minimum sales age for tobacco products and vapor products from 18 to 21 years of age.
