State tobacco-related legislative bills that have been acted on by a state legislative committee or state legislature are listed below alphabetically by state:
California: Senate Bill 424, which prohibits the sale of cigarettes with single use filters and single-use e-cigarettes, passed the Senate Committee on Environmental Quality on April 24, 2019. Senate Bill 38, which would prohibit the retail sale of flavored tobacco products and allows for greater restriction through local laws, was placed in suspense by the Senate Appropriations Committee on April 22, 2019, as was Senate Bill 193, which criminalizes the sale of nitrous oxide by retailers who primarily sell tobacco.
Colorado: House Bill 1076, which prohibits the use of vapor products where smoking is already prohibited, passed the House and moved to the Senate on April 18, 2019. HB1076 contains an exemption for tobacco shops and cigar bars.
Indiana: House Bill 1444, which imposes an electronic cigarette tax of 20% of retail, failed when the conference committee reports were not delivered to the floor and the legislature adjourned on April 24, 2019.
Maine: LD551/SP173, which prohibit a person from selling, furnishing or giving away a liquid nicotine container, reported “ought not to pass” from the Health and Human Services Committee on April 23, 2019
Michigan: Senate Bill 106, which prohibits the purchase of vapor products by minors, passed the Senate on April 23, 2019. Senate Bill 155, which prohibits the sale of e-liquid unless in a child-resistant container and also prohibits self-service displays of vapor products, passed the Senate on April 23, 2019.
Minnesota: An amended version of House File 2125, which requires an annual increase adjustment of the excise tax rate on cigarettes, passed the House and moved to the Senate on April 25, 2019. Provisions that would have increased the excise tax cap for cigars by $3.00 per cigar (from 50 cents to $3.50 per cigar), and would have redefined "premium cigar" to require the cigar to be hand-rolled, were removed from the amended version of the bill. An amended version of House File 2414, which increases the tobacco sales age to 21 years of age, and expands the definition of “smoking” to include e-cigarettes, ensuring e-cigarettes are prohibited where smoking is prohibited, passed the House and moved to the Senate on April 25, 2019.
Nevada: Senate Bill 81, which makes wholesale and retail licensing requirements for cigarettes and other tobacco products uniform, passed the Senate Committee on Revenue and Economic Development on April 22, 2019.
Texas: House Bill 3218, which requires an additional permit ($150 annual fee) to sell vapor products, and contains penalties at the following rates: $1,000 for a first violation; $5,000 for a second violation; and $10,000 for a subsequent violation, was tabled in the House Public Health Committee on April 17, 2019.
Vermont: Senate Bill 86, which increases the legal age for buying and using cigarettes, electronic cigarettes and other tobacco products from 18 to 21, passed the House and sent to the Senate for concurrence on April 24, 2019.
Washington: An amended version of Senate Bill 5986, which now imposes a tax on vapor products at the rate of 10 cents per milliliter, and also imposes a new tax on “heated tobacco products” at the rate of 60 cents per ounce of tobacco, passed the Senate and moved to the House on April 23, 2019. House Bill 1873, which imposes a tax on vapor products at the rate of 37% of the taxable sales price, passed the House Appropriations Committee on April 22, 2019.
