State tobacco-related legislative bills that have been acted on by a state legislative committee or state legislature are listed below alphabetically by state:
Alaska: Senate Bill 45, which as amended, imposes a tax on electronic smoking products (including e-liquid) at the rate of 35% of the wholesale price and increases the legal age to purchase and possess tobacco and vapor products to 21 years of age, is eligible for the Governor after the Senate concurred with House amendments on May 18, 2022. If signed by the Governor, the tax will go into effect on January 1, 2023.
California: Assembly Bill 1690, which, effective January 1, 2024, bans the sale of single use e-cigarette devices except those for which an FDA marketing order has been granted, was ordered to the inactive file at the request of the sponsor on May 16, 2022.
New York: Assembly Bill 1887 (same as S1021), which prohibits the sale of flavored smokeless tobacco within 500 feet of a public or private school, reported favorably from the Assembly Committee on Codes and referred to the Committee on Rules on May 17, 2022.
Rhode Island: The following bills were heard in the Senate Committee on the Judiciary and recommended be held for further study on May 17, 2022:
- Senate Bill 2117 prohibits the sale of any flavored electronic nicotine delivery system (includes menthol).
- Senate Bill 2658 allows cities and towns to create ordinances to regulate the use and sales of cigarettes, other tobacco products and electronic nicotine delivery systems.
Vermont: The General Assembly adjourned sine die on May 12, 2022.
